• Hosting, cloud services, and email marketing

Services are provided on a subscription or one-time purchase basis, as detailed in client agreements.

3. User Responsibilities

• You agree to use the Services only for lawful purposes.

• You may not reverse-engineer, resell, or redistribute our software or services unless explicitly permitted.

• You are responsible for maintaining the confidentiality of your login credentials.

• You shall not upload or transmit any malware, spam, or harmful code.

4. Third-Party APIs & Tools

Our services integrate APIs and data from third-party platforms such as:

• Meta (Facebook/Instagram)

• Google (YouTube, Gmail, Drive, Gemini)

• Twitter/X

• OpenAI (GPT Models)

You agree to comply with their respective terms and data usage policies. We do not store, share, or use any data beyond scope consented by the user.

5. Intellectual Property

All content, software, logos, branding, and systems developed by or for MankiMedia are the intellectual property of SanamDesigns Wallah Pvt. Ltd. Unauthorized reproduction, redistribution, or commercial use is strictly prohibited.

6. Data Protection & Privacy

Our data handling practices are governed by our Privacy Policy. We comply with:

• Indian IT Act 2000

• GDPR (Europe)

• CCPA (California)

• Platform-specific policies (Google, Meta, OpenAI, etc.)

You may request access or deletion of your data anytime by contacting hello@manki.space.

7. Subscription, Fees & Refunds

• Subscription fees are billed as per the agreed terms (monthly/quarterly/annual)

• Fees are non-refundable once a project or campaign begins

• Free support and changes may be limited based on service type

8. Termination of Services

We reserve the right to terminate your access to services if you:

• Violate any terms of this agreement

• Misuse our platforms

• Engage in fraudulent, harmful, or illegal activity

Post-termination, we may retain service logs for auditing purposes.

9. Limitation of Liability

We are not liable for:

• Third-party service downtime

• Force majeure events

• Losses due to incorrect platform integrations

• Client-side misconfiguration or misuse

Maximum liability shall not exceed the amount paid by the user for the disputed service.

10. Modifications to Terms

We may revise these Terms at any time. By continuing to use our services, you agree to the updated terms. Users will be notified via email or prominent website notice for major changes.

11. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any disputes shall be subject to the jurisdiction of courts in Nagaon, Assam and Guwahati, Assam High Court.
